What Happens if Someone Hits You and They Don’t Have Insurance?

Did you know 1 in 8 drivers in Georgia do not have car insurance? Yes, it is hard to believe these stats in 2025 with all the new technologies used today in law enforcement from police cameras, FLOCK cameras and school zone cameras. But, it is true.

Anyone that does not have insurance is considered to be uninsured.

AND

For those drivers that DO have insurance – many only carry the minimum liability insurance that is required under Georgia law – $25,000 per person and $50,000 per accident. That’s hardly enough to pay your medical bills and other damages if you were involved in a serious accident that was not your fault.

When you are in an accident with someone who has insurance but does not have enough insurance – that person is underinsured – meaning they do not have enough insurance coverage to pay for the damages they caused.

So how can you protect yourselves from these uninsured and underinsured drivers?

Macon, Georgia Car Accident Attorney Ashley Brodie discusses why Uninsured or Underinsured coverage is one of the most important car insurance coverages you can have in Georgia.

Why Being in an Accident by an Uninsured or Underinsured Driver Is More Common Than You Think

1 in 8 drivers in Georgia do not have insurance and for those that do, the majority only have the minimum required liability coverages – $25,000 per person and $50,000 per accident.

So what happens if you are in an accident with an uninsured driver or with an underinsured driver with damages exceeding their policy limits?

This is a common scenario that we see far too often.

Often times when this happens, the injured party that was not at-fault for the accident is left holding the bag.

However, there is a way to protect yourself.

That’s through uninsured/underinsured motorist coverage (UM coverage). Unlike liability insurance, UM coverage is not required by law. This means many people forgo or waive this important coverage. We see this far too often and many times when someone waives this coverage they don’t fully know what it is and how important it can be.

What Does Uninsured or Underinsured Insurance Cover?

Uninsured or underinsured coverage is part of your own insurance policy that steps in to cover you if the driver who caused your accident does not have insurance or not enough insurance to cover the damage they caused.

In other words, if you get hurt and the at-fault driver can’t pay or doesn’t have enough insurance, your UM or UIM coverage will help cover things like:

  • Medical bills

  • Lost wages

  • Pain and suffering

  • Long-term medical needs

  • Funeral costs

Think of it as a safety net you hope you never need.

Will it Raise My Insurance Rates if I Use My UM/UIM Coverage?

No. If the accident was not your fault, using your UM/UIM coverage will not and cannot raise your rates in Georgia.

Georgia law protects you from being penalized for using this insurance coverage when another driver is at fault for causing the accident.
